Abby’s World Travel Terms and Conditions

(Pty) Ltd, Registration Number 2016/156134/07

Abby’s World Travel provides clients with travel and/or other services on behalf of principals and/or other agents engaged in, or associated with the Travel Industry, including inter alia, airlines, tour operators, hotels, or any other travel arrangements, products or services (“the Supplier/s”).

Liability

2.1 Acts as agents/brokers only on behalf of the Supplier/s and accordingly on receipt by Abby’s World Travel of any booking, Abby’s World Travel shall transmit any such booking to the Supplier/s concerned and endeavour to secure the necessary reservations and arrangements. 


2.2 Neither Abby’s World Travel, nor any holding, parent, subsidiary, affiliated or associated company or representative of Abby’s World Travel shall be liable for any loss, injury of, or damage to your person and/or property whatsoever arising from any actions, errors or omissions on the part of the Supplier/s. 

2.3 The Supplier/s for whom AWT acts as agents may in turn be acquitted from responsibility in that they act as an agent themselves or have contracted out of liability, and it is therefore recommended that supplier terms and conditions be understood and appropriate insurance be taken out for all travellers.
Bookings, Change of Arrangements, Routes

3.1 “The booking” or “the reservation” refer to part, or all of the travel arrangements for transportation, accommodation, sightseeing and other travel/tourism services made on behalf of a client with Supplier/s.
3.2 All bookings are made subject to the terms and conditions specified by the Supplier/s and by signing the booking or reservation form, you become contractually bound to the Supplier/s’ terms and conditions pertaining to such booking. 


3.3 In the event of there being an unscheduled extension or curtailment to the booking caused by flight delays, bad weather, terrorism or changes due to war, political unrest, acts of God, epidemics or pandemics, strike or any other cause that is beyond the control of Abby’s World Travel, any expenses relating to these unscheduled extensions (hotel accommodation, etc.)  will be for your account and there shall be no right to any refund in respect of the curtailed portion of the booking.


3.4 Passengers deviating from the Tour, or leaving the tour for any reason, will be responsible for any costs and will not receive any refund for places not visited. 

Reservations, Payment and Additional Charges

4.1 A deposit of R 4500 is required to secure a reservation and is paid on acceptance or confirmation of services, with the balance to be paid 3 months prior to departure. If your booking is made within 3 months of departure, the total cost of your travel arrangements must be paid at the time of booking. Clients reservation is not considered firm until we have received a full deposit and a completed reservation form. Only Electronic Payments (EFT) is accepted. Banking details are supplied on the invoice. NB: Use the reference number found on your invoice when making payments.


4.2 All bookings made or reservations held by or on your behalf, are subject to payment being made of deposits and/or full payment, on or before the due date specified in the booking confirmation. In the absence of other arrangements/time periods for payment, specified in the booking confirmation, full payment for any booking shall be due 3 months prior to departure. 


4.3 Prices quoted do not include any items or services not specified in the booking confirmation, and which items may include: airport taxes, cost of obtaining visas and passports, telephone calls, laundry, meals and beverages, etc. Prices quoted cannot be fixed until such time as full payment has been received by and final documentation has been issued (“the Booking Finalisation Date”). Prices quoted may vary up to the Booking Finalisation Date due to possible supplier price changes and currency fluctuation and any additional costs shall be solely for your account. 


4.5 Abby’s World Travel reserves the right to cancel any booking made or reservation held, should the deposit and/or full payment due, not be received on or before the date specified in the booking confirmation/these Terms and Conditions.  Abby’s World Travel reserves the right to raise additional charges/fees for late bookings and alterations/amendments after the booking confirmation has been finalised. Interest at 2% above the current prime bank overdraft rate will automatically be applied to all overdue amounts. Any invoice and/or statement received by you shall be payable in full and no deduction or set off may be made by you.


4.6 Payment

Final payment is due 90 days prior to departure and must be received on time. Payments not received on time will result in reservation cancellation without refund.

Pricing

5.1 Quoted tour prices include planning, handling and operational charges and are based on the current rate of exchange and tariffs. In the event of a marked change in foreign exchange rates, fuel costs or tariff rates, tour costs are subject to revision. Such increases will be added to the client’s final invoice. Abby’s World Travel reserves the right to vary itineraries and prices, and to substitute facilities and hotels of equal or better quality if necessary.


5.2 Included in Tour Price

Air travel, all motor coach and land transportation, sightseeing, admissions, services of tour director and driver, hotel accommodation on sharing basis, daily breakfast and dinner as specified in tour itinerary, taxes, & gratuity to guide & driver.


5.3 Not included in Tour Price

Cost of obtaining passports or visas, laundry, lunch meals, beverages, sightseeing not included in the itinerary, travel insurance, & excess baggage fees.

 

Supplements


5.4 Additional price for a Single Supplement

Single supplements are added for passengers that do not have a roommate. Abby’s World Travel will help with combining those who are willing to share a room but will not guarantee that a share will be available. If a roommate cannot be found, a single passenger is responsible to pay the single supplement charge.

Cancellation

6.1 In the event of cancellation of the booking for any reason whatsoever, partially or in full, by or on behalf of you, reserves the right to claim the services, communication and cancellation charges reasonable in the circumstances or specified in the booking confirmation and which charges will inter alia depend on the debits receives from the Supplier/s with whom the reservations were made on your behalf.

  • Service Fee:
    • 91+ Days Prior: R1500 per person service fee -refer to Service Fee Structure below
  • Tour:
    • 90-61 Days Prior: Deposit Amount: R4500 per person
    • 60-46 Days Prior: 40% of tour cost lost retained
    • 45-31 Days Prior: 65% of tour cost lost retained
    • 30-8 Days Prior: 85% of tour cost lost retained
    • 14 Days Prior or less: 100% of tour cost lost retained
  • Flights:
    • 91+ Days Prior: R1600 per person
    • In the event that you cancel your trip and the air ticket has already been purchased airline policy cancellation will apply.

6.2 Generally no refunds are entertained by or the Supplier/s of travel services for no-shows or unused services.

 

 

 

 

 

 

 

 

 

Abby’s World Travel reserves the right to retain the whole or part of the Tour price paid in the event of cancellation. Written notice to this effect is required. Please see below for percentage cancellation terms for tour and air. Cancellation in writing must be received by Abby’s World Travel 91 days prior to departure for refund of tour deposit minus service fees.

Service Fee Structure

7.1 When signing up for a tour offered by Abby’s World Travel, a deposit is required to confirm your reservation. Part of the deposit for the advertised tour includes a R1500 per person service fee that is non-refundable and non-transferable in the event the traveller on deposit is unable to travel due to either the traveller cancelling or the tour being postponed, suspended or cancelled due to but not limited to acts of God, war, terrorist acts, political unrest, epidemics or pandemics. In registering for a tour, a tour member agrees to the service fee as well as the terms and conditions as outlined on the tour reservation form.

7.2 Service Fee at time of deposit: R1500 (Normal cancellation terms and conditions apply within 90 days.

7.3 By signing the tour booking form, travellers understand, acknowledge, and accept for themselves and the travellers included in their party/reservation. Abby’s World Travel service fee structure will apply in the event the tour is cancelled, postponed or suspended.

Travel Insurance

Abby’s World Travel is available to assist the traveller obtaining travel insurance, on request. Any instruction to obtain travel insurance, must be in writing and any policy of insurance so obtained, will be subject to such exceptions and conditions as may be imposed by the insurance company or underwriters issuing the policy of insurance. The traveller shall be solely responsible to ensure that any travel insurance policy meets with the travellers requirements, including but not limited to conducting his/her/its own investigation into the exceptions and conditions that are imposed under any policy of insurance; and effect any separate insurance required for any risks so excluded, as required by the traveller in his/her/its sole discretion. The company shall not be held responsible or liable: for any advice which it or its representatives furnish in relation to travel insurance; or for filing/prosecuting a claim on the traveller’s behalf against any insurer/underwriter who has issued a policy to the traveller; for any claim disputed/rejected by the insurers.

Abby’s World Travel strongly suggests purchasing a travel insurance.  Insurance costs are based on the total tour cost, including air taxes and charges listed under "Not Included." These charges are added to the final invoice. Approximate amounts can be given at time of reservation in order to purchase the appropriate amount of insurance.

Proof of South African Citizenship Passport, & Minor Children Requirements

Minors traveling with either one parent or no parents must have a certified letter of permission from the parent or parents who is/are not traveling. This letter must be presented at airport check-in. All international tours require a current passport. Entrance to most countries requires your passport be valid for 6 months after your return date. Your passport number must be recorded by Abby’s World Travel when making your reservation. Names on airline tickets must appear as shown on passport. Photocopies are not acceptable forms of identification.

Air Travel

11.1 Your Tour Package includes international air transportation. Your airfare will be quoted inclusive of all fuel, taxes and fees and will be quoted as non-refundable unless otherwise noted. NB: Quoted airfare rates are subject to change until paid in full. Assigned seating may be limited and may not be available on every flight or departure date. Since most airlines now charge for assigned seats, there may be supplements in additional to the quoted airfare to confirm assigned seats. Abby’s World Travel is not responsible for unforeseen flight delays or changes due to war, political unrest, acts of God, epidemics or pandemics. Air schedules may be subject to change at the discretion of the airline. Abby’s World Travel does not accept liability in the case of any passenger being denied boarding by any airline carrier due to the carrier’s overbooking of a flight.


11.2 Passengers wishing to cancel or change their air reservation may be subject to cancellation penalties. Airlines involved in tours are not responsible for any act, omission or event during the time passengers are not on board their planes or conveyances. Air schedules may be subject to change at the discretion of the airline.


11.3 Instant Purchase – Non-Refundable Airfare

Instant purchases on non-refundable airfares requires full payment at the time of booking. Once a ticket is issued, there can be no fluctuation in price due to an increase in government taxes or in airline fuel surcharges. Abby’s World Travel recommends purchasing optional travel insurance at the same time so that your non-refundable airfare may be covered if you cancel your trip for a covered reason. Upon payment, tickets will be issued immediately (during normal business hours) and once issued, are non-refundable. Once tickets are purchased, some airlines may allow for changes to the ticket and specific fee’s and allowances vary by the airline. All tickets include an administration fee from Abby’s World Travel, which hold no airline reissue value. The administration fees are not refundable under any circumstances.

Baggage

12.1 Although every effort is made to handle passengers’ luggage as carefully as possible, Abby’s World Travel is not responsible for and does not assume liability or accept claims for loss of or damage to luggage due to breakage, theft or wear and tear through hotel, group carrier or airline handling.


It is recommended for your own self-interest and protection that you have adequate insurance to cover these eventualities. There are limitations by coach and air carrier as to the number and size of bags which can be carried onboard and in bulk storage. However, during the tour, passengers are permitted one checked suitcase and one carry-on bag unless otherwise noted.


12.2 Checked Baggage Charges:
Some airlines may impose additional charges if you choose to check any baggage. Please contact your airline or refer to the airlines website for detailed information regarding their checked baggage policies. This is a fee levied by the airlines, not Abby’s World Travel, and may be subject to change.

Airline Security

It is the passenger’s responsibility to provide positive identification in the form of a passport or other required identification at the time of airport check-in.

Tour Membership & Mobility Requirements

Our tour sightseeing schedules require tour members to walk approximately 5-6KM at a time(per day) using a moderate pace and sometimes navigate uneven terrain, we cannot accept persons who cannot do that and instead require special assistance. Should any tour member's participation somehow materially add to the tour operator's cost, the tour member will be expected to pay any additional costs. The tour director retains the right to require any non-sufficiently mobile persons to stay behind when deemed necessary, and also terminate the membership of any member displaying disruptive behaviour, delaying or endangering fellow members and/or interfering with the operations of the tour in anyway.

Responsibilities

15.1 All travel documents for services issued by the Company are subject to the terms & conditions specified by the contracted supplier, which are available upon request, and are subject to the laws of the countries in which the services are supplied. Tours postponed, suspended, or cancelled due to but not limited to acts of God, war, terrorist acts, political unrest, epidemics, or pandemics are subject to service fees by Abby’s World Travel. In registering for a tour, tour members agree to the terms and conditions for the tour they have registered for. Abby’s World Travel reserves the right in its sole discretion to make changes in the itinerary and is not responsible for expenses, loss of time, money, or other incidents resulting from a change of tour scheduling made for tour members. Abby’s World Travel is not responsible for any losses or damages of personal property, injuries, thefts, or unforeseen expenses incurred by any tour member.


15.2 Explanation of Responsibilities and Tour Conditions for Abby’s World Travel:
Each client is responsible for proper documentation recommended to participate on tour. Please contact your personal physician to evaluate your ability to participate in the tour you plan to take. If you decide to make a reservation, you acknowledge and agree that you are physically well enough to travel and understand that medical facilities may not be similar to what you are accustomed to at home.You should bring enough medication with you for the trip. Any person reserving or purchasing any Abby’s World Travel product published on the website accepts the condition that Abby’s World Travel reserves to itself the exclusive right to change or cancel itineraries, hotels, and other tour components whenever it is deemed necessary, including for tours designated as “guaranteed departures.” If this occurs, every effort will be made to offer alternate dates and/or programs. Published times on itineraries are as accurate as possible but subject to change due to traffic, weather, mechanical and any other conditions beyond the control of Abby’s World Travel that prevent Abby’s World Travel from operating as scheduled. Abby’s World Travel expressly disclaims any liability for any damages that may be incurred for any changes cancellations or delays on any itinerary on any tour.


15.3 All rates on foreign tours are subject to fluctuations of currency. A supplement or reduction may be added to the advertised tour price at time of final invoicing should exchange rate fluctuations change the advertised tour costing.


15.4 All rates published are per person sharing as indicated and are based on double occupancy when only one rate is shown. Reservations will be accepted subject to availability at the time of request and will be considered confirmed only upon receipt of a minimum deposit and completed reservation form.

Disclaimer

Abby’s World Travel is informed about travel situations around the world including travel advisories. Conditions may require Abby’s World Travel to change, postpone, suspend or even cancel trips. By signing the booking form you accept the risks involved in travel and accept responsibility for your own travel decisions.
Responsibility is not accepted for losses or expenses due to sickness, lack of appropriate medical facilities or practitioners, weather, strikes, theft or other criminal acts, war, terrorism, technological problems, Acts of God, epidemics, pandemics or other such causes. Other risks may arise such as, but not limited to, hazards of traveling in foreign countries including undeveloped areas, the hazards of travel by aircraft, bus, van, train, automobile or other motorized vehicle, differing safety standards, sickness, criminal acts committed by others, allergic reactions, and/or animal encounters. You are voluntarily participating in the tour and as lawful consideration for the agreement to travel with Abby’s World Travel, you agree not to make a claim against Abby’s World Travel, its suppliers, related companies and employees for injuries, death, or any other claim and agree to release Abby’s World Travel, its suppliers, related companies and employees from any such claim. This release is binding on all members of your traveling party, as well as your estate and heirs and this provision shall be enforceable even after your trip has ended. Abby’s World Travel reserves the right to make changes in the published itinerary whenever, in their sole judgment, conditions warrant, or if Abby’s World Travel deems it necessary for the comfort, convenience, or safety of the tour and reserves the right to withdraw any tour announced. Abby’s World Travel reserves the right to decline to accept any person as a member of the tour, or to require any participant to withdraw from the tour at any time, when such action is determined by the tour manager to be in the best interests of the health, safety, and general welfare of the tour group or of the individual participant. If you are traveling with children, you are solely responsible for their behaviour and monitoring them throughout the tour.
Payment of the deposit to Pilgrim Tours constitutes acceptance of these terms and conditions.
Pilgrim Tours reserves the right to modify these terms and conditions at any time, without notice.

Errors and Omissions

While every effort is made to ensure the accuracy of information on our website or communicated through emails, errors or omissions are possible and Abby’s World Travel is not responsible for such error. If a mistake is made in invoicing, we reserve the right to correct the invoice and you will be responsible for proper payment in-order to satisfy the stated or quoted price.

Interpretation, Law Applicable and Jurisdiction

The Parties hereby consent to the jurisdiction of the appropriate Magistrate’s Court in regard to any action and/or proceedings based on/or arising from these Standard Conditions of Business. 
This document reflects the only and full agreement between you and any variation and/or extension thereof shall not be valid unless agreed to by in writing.
